OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. The Dog Days of Summer Contest (the “Contest”) is sponsored by Young Broadcasting of Sioux Falls, Inc. d/b/a KELOLAND TV (“KELOLAND”) and Lewis Drug (“Lewis Drug”) (together, the “Contest Parties”).

Contest is only offered in the KELOLAND viewing area in the South Dakota counties of Aurora, Beadle, Bennett, Bon Homme, Brookings, Brown, Brule, Buffalo, Butte, Campbell, Charles Mix, Clark, Clay, Codington, Custer, Davison, Day, Deuel, Dewey, Douglas, Edmunds, Fall River, Faulk, Grant, Gregory, Haakon, Hamlin, Hand, Hanson, Harding, Hughes, Hutchinson, Hyde, Jackson, Jerauld, Jones, Kingsbury, Lake, Lawrence, Lincoln, Lyman, Marshall, McCook, McPherson, Meade, Mellette, Miner, Minnehaha, Moody, Pennington, Perkins, Potter, Roberts, Sanborn, Shannon, Spink, Stanley, Sully, Todd, Tripp, Turner, Walworth, Yankton and Ziebach, the Minnesota counties of Lincoln, Murray, Nobles, Pipestone and Rock, the Iowa counties of Lyon and Osceola, the Nebraska counties of Boyd and Cherry, the Wyoming counties of Crook and Weston, and Carter County, Montana (the "Contest Area"). Void outside the Contest Area and where prohibited.

Contest is subject to all federal, state and local laws. KELOLAND shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding entries, deadlines, votes, winner selection, prize restrictions, and eligibility — and all of its decisions are final. By entering, voting, or otherwise participating in the Contest or accepting a prize, you irrevocably, fully and unconditionally agree to be bound by these Official Rules and waive any right to claim ambiguity in these Official Rules and or any other Contest-related advertising or materials.

Contest begins on August 3, 2015. Entry deadline is August 21, 2015 at 11:59 p.m. Central Time (“CT”). Public voting to determine potential winner will be held from August 22, 2015 to August 31, 2015. Winner will be announced on or about September 1, 2015. KELOLAND’s computer is the official time-keeping device for this Contest.

ELIGIBILITY

To be eligible, you must meet all of the following eligibility requirements:

You must be at least eighteen (18) years old and a legal resident of the Contest Area (above) with a street address within the Contest Area. Post office boxes will not be accepted; and

Employees of KELOLAND, Lewis Drug, any other entity directly involved in the development or administration of this Contest, and the members of their immediate families (defined as spouses, parents, siblings and children) and households, are not eligible to enter or win. The term "household" includes all persons residing together in a single residence, whether or not related.

Prize & PRIZE RESTRICTIONS

Grand Prize (1): $500 Lewis gift card. Approximate Retail Value: $500.
Gift card prize is subject to all terms and conditions thereon as well as any additional limitations or restrictions imposed by issuer. Visit www.lewisdrug.com for more information.
All prize details shall be at KELOLAND’s sole discretion. Winner assumes sole responsibility for all expenses and incidental costs associated with the prize not explicitly outlined above, including without limitation, all federal, state and local taxes (if any), surcharges, and fees. Any person who wins prizes through any KELOLAND-sponsored promotions with cumulative value equal to or greater than $600 in a calendar year will receive an IRS 1099 Form.
Prize is not redeemable for cash and may not be sold, bartered or auctioned. Prize or portion thereof not accepted by winner is forfeited and no cash or substitute will be offered or permitted. The right to receive any prize is not transferrable. Prize may not be substituted except that KELOLAND in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.
Prize offered is provided “as is” with no warranty or guarantee either express or implied by ContestParties. Contest Parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize. Other restrictions apply.

Entry Period (8/3/15 - 8/21/15)

Entries will be accepted beginning August 3, 2015 at 12:01 a.m. CT and ending August 21, 2015 at 11:59 p.m. CT (the “Entry Period”).

To enter, visit keloland.upickem.net/engine/welcome.aspx?contestid=181864 (the “Contest Page”) during the Entry Period and follow the instructions to complete an official entry form with all required information, which may include your name, address, telephone number, e-mail address, and date of birth or age (the “Required Information”) and upload a photograph of a dog in summer (a “Photo”).

Each Photo must comply with any and all terms of use and user conditions (together the “Website Terms”) at the Contest Page, as well as the “Submission Requirements” below. Your entry is only complete when the confirmation box indicates that your Photo and entry have been successfully uploaded.

This is the only method of entering this Contest and entries will not be accepted via e-mail, regular or any other method.

Submission Requirements

Each Photo must satisfy the following Submission Requirements:
1. Each Photo must be original to entrant (not copied, adapted, or reproduced from any other source and not collaboration with any other person). In other words, only the person who took the Photo is permitted to submit it in this Contest.
2. No watermarks, signatures, or copyright notices may be added to any Photo. Use of artistic filters is not permitted.
3. Do not submit collages; only single Photos are acceptable. Do not submit Photos that depict any other seasons; only Photos of dogs in summer are acceptable.
4. Any individuals identifiable in any Photo must have agreed to be so identified and entrant must be able to furnish documentation of such consent if requested by KELOLAND.
5. No identifiable brand names, trademarks, logos or trade names other than those belonging to Contest Parties should be depicted in any Photo.
6. Content that is inappropriate, lewd, pornographic, obscene, indecent, hateful, tortious, illegal, defamatory, slanderous, libelous, false, or disparaging, or that invades any person’s privacy or other rights, or that promotes or advocates drug use, bigotry, racism, hatred, or harm against any group or individual, or that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age is prohibited in any Photo.
KELOLAND may disqualify any Photo that it determines has violated the Official Rules (including the Submission Requirements), or is otherwise unsuitable, offensive, or in poor taste, at any time and disqualify the accompanying entry at any time during the Contest, even if the entry has already been submitted for Public Voting (below). You agree that KELOLAND has the sole discretion to decide whether any Photo satisfies these Official Rules and that its decisions are final.
All entries must be received by KELOLAND no later than August 21, 2015 at 11:59 p.m. CT. Proof of sending is not proof of receipt by KELOLAND. KELOLAND will not accept screen shots as proof of entry.
Limit one (1) entry per person. Additional entries received from any such person thereafter will be subject to disqualification. Any use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar entry methods or agents (including, but not limited to, contest-entry services or multiple or different e-mail addresses, identities, registrations, accounts, or logins) are prohibited and will void all entries submitted by that entrant. No group submissions will be accepted.
Each entry must include a valid e-mail address for the entrant. Contest Parties are not responsible for electronic communications that cannot be delivered due to incorrect or out-of-date information provided by entrant or that are undeliverable as a result of any form of passive or active filtering of any kind. In the event of a dispute as to the identity or eligibility of an entry based on an e-mail address, the entry will be declared made by the Authorized Registered User of the e-mail address used at time of entry. “Authorized Registered User” is defined as the person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Entrants who fail to provide any Required Information may be disqualified without further notification by KELOLAND. KELOLAND is not responsible for entries that are lost, misdirected, garbled, distorted, truncated, incomplete, illegible, incorrect or late for any reason, and all such entries are void. KELOLAND reserves the right in its sole discretion to disqualify any entry at any time that in its opinion does not comply with these Official Rules, even if it has already been submitted to Public Voting. Entries become the property of KELOLAND and will not be returned or acknowledged.
The information that you provide in connection with the Contest may be used by KELOLAND in accordance with KELOLAND’s Privacy Policy, which is found atwww.keloland.com/custompages/privacy.cfm and which may be updated from time to time.

Entrant’s Warranty/Indemnification/License
By submitting or entering any Photo, you warrant that such Photo is original to and created solely by you and was not copied, in whole or in part, from any work belonging to anyone else and that it does not violate any copyright laws or plagiarize, libel, slander, defame, disparage, or otherwise infringe on or violate the rights of any third parties.
By submitting or entering any Photo, you further warrant that (a) any and all persons who are identifiable therein have agreed to be so identified in this Contest; (b) you are legally entitled to submit the Photo in the Contest; (c) the distribution, reproduction, display and any other uses of the Photo by KELOLAND as permitted herein will not infringe any third party rights, including those of any person who is identifiable in the Photo; and (d) your entry in all other respects complies with these Official Rules.
By submitting or entering any Photo, you agree to indemnify and hold harmless Contest Parties, their parent companies and subsidiaries, and their respective officers, directors, employees and affiliated organizations, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by you of these Official Rules or the warranties and/or representations made by you pursuant to these Official Rules.
Finally, by submitting or entering any Photo, you expressly grant to KELOLAND (and to those acting on KELOLAND’s behalf) a non-exclusive, perpetual, world-wide royalty-free license (and waive all moral rights in and to the Photo) to display or otherwise use the Photo on the Contest Page and any related sites in connection with this Contest.

Public Voting (8/22/15 - 8/31/15)
Beginning on August 22, 2015 at 12:01 a.m. CT and ending on August 31, 2015 at 11:59 p.m. CT (the “Public Voting”), all timely and properly submitted Photos will be displayed at the Contest Page where registered users who visit the Contest Page (collectively referred to as “Voters”) may view and vote for their favorite Photos. You may vote for your own entry.
Voting is limited to one (1) vote per Voter per Photo per day. For purposes of voting limits, a "day" begins at 12:00:01 a.m. CT and ends at 11:59:59 p.m. CT. Additional votes received from any such Voter thereafter will be subject to disqualification. The use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar methods or agents or multiple accounts or log-ins to vote is prohibited and may result in the disqualification of all votes received through that method and/or from that Voter. Entrants, Voters and other participants are prohibited from obtaining or soliciting votes by offering prizes or other inducements to members of the public, vote farming, vote purchasing, vote exchanging, or any other activity that artificially inflates such votes as determined by KELOLAND in its sole discretion. Without limiting the foregoing, KELOLAND reserves the right to determine in its sole and absolute discretion whether any votes are invalid and to disqualify any duplicate, suspect or otherwise invalid votes. Irregular or suspect votes or votes in excess of the stated maximum number above, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or source or by the use of multiple e-mail addresses, accounts, or log-ins will be considered invalid.

All votes must be submitted no later than August 31, 2015 at 11:59 pm CT. KELOLAND will not accept screen shots as proof of voting. KELOLAND is not responsible for, and Voters assume all risk of, votes that are lost, garbled, distorted, incomplete, or containing errors or if for any reason they are not recorded by KELOLAND prior to the stated deadline, and all such votes are void. Voters who fail to include any of the information required below may be disqualified from further participation and their votes voided without further notification by KELOLAND. KELOLAND reserves the right in its sole discretion to disqualify any vote or Voter at any time that in its opinion does not comply with these Official Rules.

Each Voter must provide a valid e-mail address. KELOLAND is not responsible for electronic communications that cannot be delivered (including those necessary to audit, validate or confirm any votes) due to incorrect or out-of-date information provided by any Voter or that are undeliverable as a result of any form of passive or active filtering of any kind.

At the conclusion of the Public Voting, the voting results will be tabulated by KELOLAND. Subject to verification of eligibility, the entrant whose Photo receives the highest number of votes during the Public Voting will be declared the Grand Prize winner. KELOLAND reserves the right to select fewer than the stated number of winners if there are not a sufficient number of eligible and properly submitted entries.

Regardless of the results displayed on the Contest Page or “leader board,” no entrant will be a “winner” or a particular prize winner until the results have been confirmed by KELOLAND and its decisions shall be considered final and binding in all results. In the event of a tie for any winner, the winning entry will be selected at random from the tied entries.

KELOLAND will contact the potential winner in accordance with the information supplied to KELOLAND on his or her entry form. Winner must respond to initial notification within seventy-two (72) hours and may be required to present valid photo identification and/or to sign an affidavit or declaration of eligibility, liability waiver, publicity release (where legal), tax forms and/or other legal documents to KELOLAND no later than ten (10) business days after initial notification and as a condition of receiving prize. KELOLAND, in its sole discretion may allow for transmission of verification documents via fax or e-mail. Arrangements will be made with verified winner for pick-up or delivery of prize.
In the event that potential winner (a) cannot be contacted directly by, or does not respond to, KELOLAND within seventy-two (72) hours of initial attempted notification, (b) fails to satisfy any eligibility or verification requirement herein, (c) declines to accept the prize, or (d) is otherwise determined to be ineligible, KELOLAND in its discretion may disqualify that individual and an alternate winner will be selected in accordance with previously described method as soon as reasonably practicable after such disqualification. Any alternate winners are subject to all eligibility requirements and restrictions of these Official Rules. KELOLAND will make up to three (3) attempts to verify an alternate winner. If KELOLAND cannot verify an alternate winner after three (3) attempts, no further attempts will be made and the prize will not be awarded.
KELOLAND, in its sole discretion, may post the verified winner's name on the Contest Page and/or any of KELOLAND’s websites, including www.keloland.com and www.my-utv.com and broadcast it on any KELOLAND station.

PUBLICITY RELEASE
By accepting a prize, winner agrees to award KELOLAND the right to publicize his or her name, photographs (including the use and appearance of winner's photograph and the winning Photo on KELOLAND’s websites), likeness, biographical information, e-mail address, voice and details of winning for purposes of this and future promotions without further compensation, except where prohibited.

LIMITATION OF LIABILITY/DISCLAIMER OF LIABILITY
By entering, voting, accepting a prize and/or otherwise participating, you agree that KELOLAND, Lewis Drug, Media General, Inc., Facebook, any other company involved in the development or administration of this Contest, and a range of subsidiaries, agencies, affiliates, franchisees, promoters, prize suppliers, directors, officers, employees, agents and related persons (collectively, the “Released Parties”): (a) are not responsible for technical failures of any kind, including but not limited to lost, disconnected, interrupted, or unavailable network, server, or other connections, late, lost, undeliverable, damaged or stolen mail, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for entries or votes that for any reason are not received by KELOLAND by any deadline stated above; (b) are not responsible for any incorrect or inaccurate information, whether caused by entrants, Voters or other persons, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest or in the printing of this offer, administration of this Contest, or in the announcement of the winner or the prize;(c) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this Contest or downloading of any software or materials; (d) are not responsible for unauthorized human intervention in any part of the Contest, including without limitation, the entry process or the Public Voting; (e) are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Contest, the acceptance of entries, the display of entries, the receipt or tabulation of votes, the selection of winner, the prize or otherwise in any Contest-related materials; (f) are not responsible for any unauthorized third party use of any entry (including any Photo); (g) are not responsible for the inability to select the winner because of postal failure, equipment failure, or data storage failure; and (h) are released from any and all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, arising in whole or in part directly or indirectly, from participating in the Contest (in whole or in part), the use (including modification, adaptation, and reproduction) of entry materials (including any Photo) during or after the Contest, and the delivery, acceptance, possession, redemption, use, misuse, loss, or misdirection of any prize.
RELEASED PARTIES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO THE prize. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE Contest OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR ERRONEOUS PARTICIPATION, AWARD OF any prize OR OTHER BENEFITS UNDER THESE OFFICIAL RULES. RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE Contest Page OR RELATED WEBSITES WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE Contest. RELEASED PARTIES WILL NOT BE LIABLE, AND ARE NOT RESPONSIBLE, FOR DAMAGES OF ANY KIND RELATED TO YOUR PARTICIPATION IN OR INABILITY TO PARTICIPATE IN THE Contest, WHETHER THE DAMAGES ARE DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL.
BY ENTERING, VOTING, ACCEPTING A PRIZE AND/OR OTHERWISE PARTICIPATING IN THEContest, you AGREE THAT THE RELEASED PARTIES SHALL NOT BE LIABLE FOR, AND WILL BE HELD HARMLESS BY YOU AGAINST, ANY LIABILITY FOR ANY DAMAGE, INJURY OR LOSS TO PERSON (INCLUDING DEATH) OR PROPERTY RELATED IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, TO ACCEPTANCE, POSSESSION, REDEMPTION, USE OR MISUSE OF PRIZE, PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY, USE BY A RELEASED PARTY OF ANY ENTRY (INCLUDING ANY Photo), PARTICIPATION IN THE Contest, OR ANY OTHER CLAIM OR CAUSE OF ACTION YOU MAY HAVE AGAINST A RELEASED PARTY.
SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.

MISCELLANEOUS
KELOLAND reserves the right to cancel, suspend or terminate this Contest, or any part thereof, in the event that KELOLAND determines, in its sole discretion, that the security, administration, fairness and/or operation of the Contest has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or any other cause beyond KELOLAND’s control. In such an event, KELOLAND will post notice of same at the Contest Page and select the winner as applicable from among all non-suspect eligible entries received at the time of the Contest termination in accordance with previously described selection process if possible or in such other method as KELOLAND, in its sole discretion, deems fair and appropriate under the circumstances.
KELOLAND reserves the right to disqualify any individual from further participation in the Contest (including participation in the Public Voting or consideration for the prize) if KELOLAND concludes, in its sole discretion, that such person (a) has attempted to tamper with the entry process, the Public Voting, or the operation of the Contest in any other way, (b) has colluded to unfairly affect the outcome of the Contest, (c) has repeatedly disregarded or attempted to circumvent these Official Rules, or (d) has acted towards KELOLAND or any other Contest Party, entrant, Voter, or any other participant in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to enter or vote more than the number of times permitted herein, including through the use of any prohibited device or method, or to attempting to obtain or solicit votes using any prohibited device or method. Any such decision by KELOLAND is final, binding and unappealable in all respects. Any failure by KELOLAND to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.
ANY ATTEMPT BY ANY INDIVIDUAL TO DEFRAUD, TAMPER WITH, OR DELIBERATELY UNDERMINE, THE LEGITIMATE OPERATION OF THE Contest MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND KELOLAND RESERVES THE RIGHT TO PURSUE ANY AVAILABLE DAMAGES OR REMEDIES AGAINST SUCH INDIVIDUAL AND/OR REFER SUCH MATTERS TO LAW ENFORCEMENT FOR PROSECUTION TO THE FULLEST EXTENT PERMITTED BY LAW.
All activity arising out of and relating to the Contest, including any reference to the status of any entrant as a "winner" is subject to verification and/or auditing for compliance with the Official Rules. If KELOLAND determines, in its sole discretion, that verification or auditing activity evidences non-compliance of an entry and/or entrant with the Official Rules, KELOLAND reserves the right to disqualify such entry and/or the corresponding entrant from the Contest and any prize at any time. KELOLAND reserves the right to conduct a background check on any or all potential winners and to disqualify any individual based on such background check if KELOLAND determines in its sole discretion that awarding a prize to any such individual might reflect negatively on KELOLAND. By entering, participating or accepting a prize, you agree to cooperate with KELOLAND and its representatives in connection with any and all verification, auditing and/or background check activities.
KELOLAND reserves the right to correct typographical, printing or clerical errors in any Contest-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, KELOLAND reserves the right to award only the stated number of prizes by a random drawing from among all legitimate, un-awarded, eligible prize claims.

DISPUTES
By entering, voting, accepting a prize and/or otherwise participating in any way in the Contest, you agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering or voting in the Contest, but in no event attorneys' fees; and (c) under no circumstances will you be permitted to obtain any award for, and you voluntarily and freely waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages other than actual out-of-pocket expenses. Some jurisdictions do not allow for limitations on the ability to pursue class action remedies, or certain kinds of damages, and so these limitations may not apply to you.
By entering, voting, accepting a prize and/ or otherwise participating in any way in the Contest, you further agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations or those of Released Parties in connection with the Contest, shall be governed by South Dakota law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than South Dakota and you expressly (a) agree that any legal proceedings arising out of or relating in any way to thisContest or these Official Rules shall be brought only in the federal or state courts located in Minnehaha County,South Dakota, and (b) consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.
In the event of any discrepancy or inconsistency between any terms or conditions of these Official Rules and any disclosures or other statements contained in any other Contest-related materials, including but not limited to the Contest entry forms, or point of sale, television, print, mobile or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control. In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
